told one of the teammates. as the prosecution's case came to a close, five of his teammates on the university lacrosse team were called to the stand to testify about the defend's behavior in the hours leading up to the murder. all of them told the court that he had been drinking heavily that day and described him as noticeably drunk. one describe him as slurring his words saying inappropriate things and another describe him as being belligerent. four out of the five attended a father-son golf outing and said that he was drinking heavily. all testified seeing him immediately before and after the murder. ken claussen told the youry that he lived to him about had the whereabouts before police say that yeardley love was killed. he said a drunk huguely came into their apartment saying he was at chris clemonss apartment and he was drunk. he knew that not to be true and confronted huguely. he told the court that the demeanor of george changeed.

he was sitting on the couch with a beer and a blank stare. he asked him what is wrong with you and never got a response. none of the men observe good injuries to the defendant. one of the last witnesses saw huguely around midnight, when he stuck his head into the room and saw he was in bed and went to use the bathroom. thompson thought he was in there for 10 seconds and the prosecution believes that huguely was cleaning himself off after leaving love's apartment on may 3rd, 2010. and the jury heard from three women who say they were contacted by george huguely the night he was killed and testifyd about talking to or receiving text messages in the hours before and around the time of love's death. the text messages were not read aloud in court but on cross examination, the defense attorney asked katelin taylor if she knew george had a quote, crush on you. two other women testifyd about

hearing from huguely at 11 -- between 11:30 and midnight the night of the murder. the defense began its case after 3:00 this afternoon with the defense attorney francis lawrence calling for the stand of toxicologies from virginia commonwealth university who testified what he thought would have been yeardley love's blood alcohol level at the time of the death. he believes that it was about 16 to 18 that his point, that 0.18, i should say and thought it could be that high, although the state said in the autopsy report her blood alcohol content was .14. there is a doctor on the stand, one of six, we believe, we're going to be seeing in the defense case. shawn? >> thank you for the update tonight. jury selection began in the day trial of five men accused of several deadly shootings in the district. onland on, carter, jeffrey best, lamar williams and boast

on trial right now. prosecutors claim four of men shot a man and led to a retaliation killing the next day and later killed a 17-year- old and opened fire on south capitol street with a assault weapon, a semi automatic pistol killing three teenagers. >> attempt a culpeper police officer shot and po- year-old -- 40-year-old woman. the unidentified officer claims she shot patricia cook when he tried to drive off with his arm in her car window. she refused his orders to stop and the officer responded to a call for a suspicious woman in a parking lot. fauquier county commonwealth attorney james fisher will take over that investigation. it could be weeks before toxiology dole reports are complete to help determine how whitney houston died. in the meantime, plans are underway for a saturday funeral which the public can so and officials have issued subpoenas to get her medical and pharmacy

. >> tempers were flaring at an upul -- annual retreat for d.c. council members yesterday. marion barry and david catanya got into a heated argument during the committee and accusations and profanities

were flying. and allen was there for the showdown and joins us to fill us in on what happened. and this started after the council was discussing the future of the united medical center. how did the two start going at it after that? >> reporter: you couldn't call it a discussion of the united medical center. the district cfo finished a presentation to on the state of district finances and council member barry spoke up about the united medical center asks the cfo about it. it's in his southeast ward. at this point, council member catanya unloaded on him and i am not sure if barry got his question answered. >> who else was in the room and how were they reacting to this? >> the other members were in the room and was the only reporter in the room. there was an atmosphere of embarrassment. some members tried to encourage them to be quiet and one noticed that i was in the room and pointed out that a journalist was sitting a few

fight away and they kept going at it and at one point, catanya office his feet screaming and i couldn't hear if barry had a response. he was drowned out by david catannia. >> tell me about the back and forth. i understand that barry accused of catanya was harboring a long- standing disrespect for black men? what was the specific back and forth? >> there were various comments about -- the comments came after the interviews with the reporters after the episode. but housed a number of expletives toward barry and described him as a despicable human being at one point and a few things not safe for television and he had a back- and-forth that was intense with council member barry and, frankly, council member barry couldn't be heard. he may have tried to respond but i can't hear him from across the room. >> and given profanes said, did -- profanities at the time,

did anyone try to break it up. >> i'm sorry? >> did anyone try to break it up? did any other council members try to step in and break it up between the two of them? >> there was a meeting facilitator the city had to try to move the meeting along and he tried to intervene. other members of the couple, like i said, tried to point out that this was an open meeting of the district of columbia's council and that that were not having any of it and they were going to argue for some time. >> thank you for being with us and giving us perspective on what was happening whole you were there. appreciate it. >> all right. >> and what is the fallout from this? matt ackland has more. >> reporter: this is not the first time that council members catanya and barry had words. they have gone at it and both used profanity. will this happen again? probably so. the question is is there anything that can be done to stop it? >> reporter: y that are both

well-known and well-liked about their aggressive style. and when they don't see eye-to- eye, it can get ugly. >> and at that point, he started cursing and saying i was despicable. >> reporter: council member barry lashed out at david catannia. this was an exchange at a meeting over hearing practices last year. >> i resent you, mr. catanya. it bothers me that mr. catanya would throw out these bosts and wild statements that this government is for sale. he's a damn liar. >> i will respectfully decline have my colleague serve as my moral and ethical compass. jury. >> i are the heated arguments going too far? chairman brown thinks so. >> we should disagree on the policy but never disrespectful to anyone. >> reporter: the latest incident between catanya and barry prompted him to call the council together to talk about its code of conduct. >> i look forward to putting

. >> listen up, ladies. your kisses could be toxic. that is the warning from a cosmetic safety group after looking at lipstick testing data from the fda. they found lead in 400 lipsticks. are we finding dangerous levels here? melanie alnwick is here to break it down for us. >> reporter: the food and drug administration has been testing lipsticks for lead since 2007. last spring, it expanded them to the 200 products. every single sample tested positive. the fda found small amounts that it has no safety concerns and some others are not convince. the two lipsticks with the most lead found in fda testing made by loreal. maybelline color sensational pink petal and loreal coluo --

county. montgomery county spends $68 per capita on healthcare, nearly double the state average. gordy joins us with the montgomery county taxpayer's league. you wrote the study and thank you for coming in. >> thank you. >> your study shows all of that money is not working. what is the problem? >> reporter: well, when we compare health outcomes that are included in a federal data base and on some community statistics, we see that neighboring counties have health -- better health outcomes in key areas like high blood pressure, premature berths and low birth rates and this is disturbing to us because of the high per capita spending, which you noted already, and the fact that this is a high priority for us in the county. >> why do you think montgomery county is falling short if it's spending more than most other

municipalities? >> i think like many things, it boils down to policies, strategies, and management. a good example would been to ageing pregnancies, where montgomery county doubled the rate of pregnancies as fairfax and howard county. some have attributed this to the high hispanic population in the county, but we so a high pis hispanic population in fairfax county as well and only half of the rate that montgomery county has. >> in the article, the director of health and human services said, quote, the communities are not exactly the same. howard county doesn't look like montgomery county. it's simplistic to say they pay 20% less and that they doing better. how do you respond to that? >> i would say this that fairfax county is a peer of montgomery county, chording to the federal department of health and human service. and our performance compared to fairfax county is inferior as

well as howard county. seems to me it's not about money but management, policies, and strategies. >> bottom line, what do you want? you represent the county taxpayer's league. what sort of changes are you looking for here? >> in this time of slow growth and austerity, one of the biggest concerns is how well we're serving the poorest of the poor, and that is folks at 100% of the federal poverty level and they're only on/3 of those poor in our county are receiving free healthcare error. we believe that is -- healthcare. we believe that is because 9 county provides up to 2 1/2 times of the level want we would like to see resources reallocated and we would like to see inefficient and ineffective programs drop, and we would like to see more bang for the buck. >> and that is going to being about -- interesting to see how the county responds to this. thank you for coming in. >> thank you. and executives are opposed to maryland's pension plans to

close a billion dollar budget deficit. governor o'malley is calling for counties to split the pension costs with the state and that would give counties more incentive to negotiate. baker said his county is facing a $126 million shortfall the next fiscal year and that pension shift would add another $44 million. >> and this is about a cut toward education. the state is not cutting education, but they're going to forcous make -- to make the drastic decisions in our budget. we can't have this happen. >> and governor o'malley said splitting pension costs with the county will save the state $239 million a year. coming up, we'll have -- why a preschooler was forced to eat chicken mcnugget's instead of her packed lunch. and also ahead, the health scare at a heart attack grill. >> and i felt horrible for the gentleman. the tourists were take photos of him as if it was a stunt. >> find out how the eatery
